Legislation

The New Mexico Educational Retirement Board (NMERB) is governed by both statute and rule.

The Educational Retirement Act (ERA) is the set of state statutes passed by the New Mexico Legislature which govern the Board and your benefits. In addition, the Board passes administrative rules which fill in some the details of NMERB operations and administration of benefits. Any rules created by NMERB cannot conflict with state statutes passed by the New Mexico Legislature. The rulemaking process incorporates the opportunity for public comment.
