Return to Work Process - Failure to comply with the process order may result in penalties. 1 - Retire; 2 - Consider working for an ERB covered employer again; 3 - Complete the ERB Return to Work Application; 4 - Be Approved by ERB before returning to work; and 5 - Return to Work.

As a reminder, any retiree receiving a pension from the Educational Retirement Board (ERB) who wishes to employed by an ERB contributing employer must submit and obtain approval of a return-to-work application from ERB prior to work commencing. This includes providing services in any part or full-time capacity, including substitute teaching. The applicable state and federal laws governing how and when a retiree can return to work without suspending their pension benefits are very specific and strict.

RETURN TO WORK PENALTIES


Pursuant to State law, failure to obtain approval prior to returning to work will result in suspension of your pension benefits and recoupment of any benefits paid while you were ineligible.
